Dangerous Precedent set by Tornado Cash?

<!-- SC_OFF --><div class="md"><p>I'm wondering if a dangerous precedent has been set when one of the Tornado cash developers was arrested because this means that the maintainers of an open source system that anyone can fork are responsible for everything that is done with it (source: <a href="https://www.coindesk.com/policy/2022/08/19/freealexpertsev-protests-planned-for-amsterdam-following-tornado-cash-developers-arrest/">Free Alex Pertsev</a>).</p> <p>I don't always agree with Hoskinson's views but I think he made a good point regarding this. He gave the hypothetical example of North Korea using using the Lines kernel and adapting it to operate an ICBM (again, just a hyptothetical example found here: <a href="https://youtu.be/fKRlwp6o7BU?t=1398">Surprise AMA</a>). If North Korea did that would the developers of the Linux Kernel be responsible for North Korea's actions? Obviously not especially if there was no intent to help North Korea in any way.</p> <p>The basis of the argument here is that writing code is free speech and should be protected. I've never used Tornado Cash myself, or any anonymizing tool for that matter, but I imagine I would have at some point when privacy becomes important for my transaction.</p> <p>Anyway, just a few thoughts on the Tornado Cash situation. What do y'all think?
